Planet Ranger Terms and Conditions of Service
Welcome to the Planet Ranger web site, a web site provided by Planet Ranger Limited
(“We” or “us”). The services provided by this web site
(“these services”) and therefore by Planet Ranger Ltd are subject
to the following Terms of Service (“TOS”). Only persons aged eighteen
years or over may agree to these terms and use the web site or the services
offered through the web site. If you choose to accept this agreement, you must
do so as it is presented to you—no changes (additions or deletions) will
be accepted by Planet Ranger Limited.
These Terms and Conditions of Service are a legal document that sets forth your
rights and obligations as a Planet Ranger user. You cannot use the services provided
by the Planet Ranger web site until you have accepted these Terms and Conditions,
and you must abide by these terms in order to have the right to use your Planet
Ranger Account.
In consideration of the use of these services, you agree to:
1. provide true, accurate, current and complete information about yourself as
prompted by our registration form (such information being the "Registration
Information") and
2. Maintain and update the Registration Information to keep it true, accurate
and current.
If you provide information that is untrue, inaccurate or not current, or if we
have reasonable grounds to suspect that such information is untrue, inaccurate
or not current, we have the right to suspend or terminate your account and refuse
further use of these services.
The Planet Ranger Basic Account service is free of charge. By creating your Planet
Ranger account, you agree that we have the right to display advertisements and
promotions on your page. The manner, mode and extent of advertising by us on
your Planet Ranger Travel Page is subject to change.
Planet Ranger Limited reserves the right to suspend or delete Basic Accounts
at any time without notice. Any Basic Account that we consider to be no longer
in use or inactive will be deleted. You may only have one Basic Account registered
in your name. Planet Ranger Limited reserves the right to delete all Basic Accounts
we consider to be held by the same person without notice.
Planet Ranger Limited reserves the right to deny access to its Basic Account
service to any individual or group who have been found in breach of these terms
and conditions in the past.
If you elect to subscribe to a Planet Ranger First Class Account, you agree to
pay all charges for a First Class Account at the prices set forth on the Planet
Ranger web site. All charges are exclusive of any value added tax ("VAT"),
sales tax or other taxes, except as required by applicable law. Planet Ranger
Limited reserves the right to change prices or to institute new charges for First
Class Accounts at any time, upon prior notice. Price changes and institution
of new charges implemented during your subscription period will apply to subsequent
subscription periods and to all new First Class accounts created after the effective
date of the change. All pricing changes will be posted on the Planet Ranger web
site, and such posting shall be considered sufficient notice to you of such changes.
You are responsible for regularly reviewing pricing information as posted so
that you have notice of such changes.
Subscriptions to First Class Accounts are not automatically renewed by Planet
Ranger Limited. If at the end of your subscription period you wish to continue
to use your First Class account, you are responsible for renewing your subscription.
You can renew your subscription by logging into your First Class account. If
you do not elect to renew your subscription, we reserve the right to delete any
or all content stored on the web site for your account.
Planet Ranger Limited will accept cancellations of your subscription within seven
(7) days of the commencement of your subscription, and you will receive a full
refund of your subscription. Applicable local law may vary this policy.
While Planet Ranger Limited makes reasonable efforts to ensure that the Planet
Ranger Web site is available at all times, we do not guarantee, represent or
warrant that Planet Ranger web site services will be uninterrupted or error-free,
and we do not guarantee that users will be able to access or use all of the Planet
Ranger features and services at all times.
Planet Ranger Limited also does not guarantee or warrant that any Content you
may have stored with your account will not be subject to inadvertent damage,
corruption or destruction. You are responsible for backing up, images or other
content. If any data, messages, images or other content in your account and stored
on the Planet Ranger web site is lost or corrupted in any way, Planet Ranger
Limited will have no obligation or liability to you.
You agree that all information, data, text, photographs, graphics or other materials
(“content”) publicly posted to the Planet Ranger web site are the
sole responsibility of the person from which such content originated. You are
entirely responsible for all content that you upload, post or otherwise transmit
via these services. Although we prohibit the uploading of certain types of content
to the web site, we cannot control the use of our web site. It is possible that
images or other material may appear on our web site which are unlawful or offensive.
We are not responsible for such images or material.
We may at our discretion contact law enforcement authorities if we believe that
anything unlawful is occurring or has occurred in relation to the web site. We
may provide copies of any relevant images or material to the law enforcement
authorities and in that connection may also give them access to any personal
data that is held by us. In registering for these services you agree to not use
these services to:
1. upload, post or otherwise transmit any Content that is unlawful, harmful,
threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous,
invasive of another's privacy, hateful, or racially, ethnically or otherwise
objectionable;
2. harm minors in any way;
3. impersonate any person or entity, including, but not limited to, a Planet
Ranger Limited official, forum leader, guide or host, or falsely state or otherwise
misrepresent your affiliation with a person or entity;
4. upload, post or otherwise transmit any content that you do not have a right
to transmit under any law or under contractual or fiduciary relationships (such
as inside information, proprietary and confidential information learned or disclosed
as part of employment relationships or under nondisclosure agreements);
5. upload, post or otherwise transmit any content that infringes any patent,
trademark, trade secret, copyright or other proprietary rights of any party;
6. upload, post or otherwise transmit any unsolicited or unauthorized advertising,
promotional materials, "junk mail," "spam," "chain letters," "pyramid
schemes," or any other form of solicitation;
7. upload, post or otherwise transmit any material that contains software viruses
or any other computer code, files or programs designed to interrupt, destroy
or limit the functionality of any computer software or hardware or telecommunications
equipment;
8. upload or post content other than text or digital images to the Planet Ranger
Web Site, this includes but is not limited to digital video, embedded computer
code, software and audio files;
8. interfere with or disrupt these services or servers or networks connected
to these services, or disobey any requirements, procedures, policies or regulations
of networks connected to these services;
9. intentionally or unintentionally violate any applicable local, national or
international law;
10. "stalk" or otherwise harass another;
11. collect or store personal data about other users;
12. promote or provide instructional information about illegal activities, promote
physical harm or injury against any group or individual, or promote any act of
cruelty to animals;
13. engage in commercial activities. This includes, but is not limited to, the
following activities:
a) offering for sale any products or services;
b) soliciting for advertisers or sponsors;
c) conducting raffles or contests that require any type of entry fee;
d) displaying a sponsorship banner of any kind, including those that are generated
by banner or link exchange services and displaying banners for services that
provide cash or cash-equivalent prizes to users in exchange for hyperlinks to
their web sites.
You retain all intellectual property rights, including copyright, to the content
that you have uploaded to the web site.
You agree that we have an unconditional non-exclusive license to display, modify,
print, transmit, distribute or delete any of the images that you upload to us.
This includes, but is not limited to the use of images or text for promotional
purposes.
You agree to indemnify and hold Planet Ranger Limited, and its subsidiaries,
affiliates, officers, agents, co-branders or other partners, and employees, harmless
from any claim or demand, including claims for legal fees, made by any third
party due to or arising out of your content, your use of these services, your
connection to these services, your violation of the TOS, or your violation of
any rights of another. You agree to pay any legal fees incurred by us due to
or arising out of your content, your use of these services, your connection to
these services, your violation of the TOS, or your violation of any rights of
another.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion
of these services, use of these services, or access to these services.
Planet Ranger Ltd reserves the right at any time and from time to time to modify
or discontinue, temporarily or permanently, these services (or any parts thereof)
with or without notice. You agree that Planet Ranger shall not be liable to you
or to any third party for any modification, suspension or discontinuance of these
services.
You agree that Planet Ranger reserves the right to amend the Terms at any time,
for any reason. Any changes to the TOS will be posted on the Planet Ranger Web
site. If any future changes are unacceptable to you, you should discontinue using
the services provided by the Planet Ranger web site. Your continued use of these
services now, or following the posting of notice of any such changes, will indicate
your acceptance of this agreement, and of any such changes.Entire Agreement
These Terms constitute the entire agreement between you and Planet Ranger Limited
and govern your use of these services, superseding any prior agreements between
you and Planet Ranger Limited. In the case of inconsistencies between these Terms
and information included in off-line materials, (e.g., promotional materials
and mailers), these Terms will always prevail.
You agree that Planet Ranger Ltd, in its sole discretion, may terminate your
account or use of these services, and remove and discard any content held on
your behalf, for any reason, including, without limitation, for lack of use or
if we believe that you have violated or acted inconsistently with the letter
or spirit of the TOS. Planet Ranger Limited may also in its sole discretion and
at any time discontinue providing these services, or any part thereof, with or
without notice. You agree that any termination of your access to these services
under any provision of this TOS may be effected without prior notice, and acknowledge
and agree that we may immediately deactivate or delete your account and content
and/or bar any further access to these services. Further, you agree that we shall
not be liable to you or any third-party for any financial or other loss which
may arise from our termination of your access to these services and/or loss or
destruction of content held on your behalf.
We run advertisements and promotions on Planet Ranger Travel Pages. Your correspondence
or business dealings with, or participation in promotions of, advertisers found
on or through these services, including payment and delivery of related goods
or services, and any other terms, conditions, warranties or representations associated
with such dealings, are solely between you and such advertiser. You agree that
we shall not be responsible or liable for any loss or damage of any sort incurred
as the result of any such dealings or as the result of the presence of such advertisers
on these services.
These terms (and the provision of services by us) are governed by
and to be interpreted in accordance with English law. In the event
of any dispute arising in relation of these terms or in relation
to the provision of any goods and services by us the English courts
will have exclusive jurisdiction over such dispute.
You agree to abide by all local rules, regulations and laws that
apply to online conduct in the country from which you are accessing
these services.
